1. The Service

Hammermind generates 2D game assets — sprites, sheets, icons, HUD elements, tilesets, and backgrounds — from text prompts via a REST API and an MCP server, using AI image models on AWS Bedrock. Features, models, and pricing may change over time.

2. Eligibility & accounts

You must be at least 18 (or the age of majority where you live) and able to form a binding contract. You are responsible for the activity under your account and for keeping your credentials and API keys secret. Treat API keys like passwords; notify us promptly of any unauthorized use. We are not liable for losses from compromised credentials you failed to protect.

3. Credits, pricing & payment

• The Service is pay as you go. You add prepaid credit (in USD) to your account; the lowest top-up is $10.
• Each successful generation debits your balance at the listed per-asset price (from $0.20). If a generation fails, the charge is refunded to your balance automatically.
• Payments are processed by Stripe. You authorize us to charge your selected payment method for credit purchases and, if you enable auto-recharge, for top-ups when your balance falls below your chosen threshold.
• Credits do not expire. Prices are exclusive of any applicable taxes, which you are responsible for.
• Credits and prepaid balance are non-refundable except where required by law.
• We may change prices prospectively; changes do not affect credit you have already purchased.

4. Acceptable use

You agree not to use the Service to:

• generate content that is unlawful, infringing, defamatory, hateful, or sexually exploitative, or that depicts real, identifiable people without rights to do so;
• violate the acceptable-use policies of our model providers (Stability AI / AWS Bedrock);
• infringe anyone's intellectual property, including by reproducing recognizable third-party characters or trademarks;
• resell or redistribute raw API access, or circumvent rate limits, balances, or security controls;
• reverse-engineer the Service, or use it to build a competing model-training dataset.

We may suspend or remove content or accounts that violate these rules.

5. Your content & generated assets

You retain whatever rights you have in the prompts and reference images you submit ("Inputs"). As between you and Hammermind, and to the extent permitted by the underlying model providers' terms, you own the assets you generate("Outputs") and may use them, including commercially.

Because outputs are produced by AI from large datasets, we cannot guarantee they are unique, original, or non-infringing, and identical or similar outputs may be generated for others. You are responsible for reviewing Outputs and ensuring your use does not infringe third-party rights or violate applicable law.

You grant us a limited license to host, process, transmit, and display your Inputs and Outputs solely to operate and support the Service.

6. Our intellectual property

The Service, website, software, and Hammermind name and branding are owned by us and protected by law. These Terms grant you no rights in them except the limited right to use the Service as permitted here.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that AI Outputs will meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, Hammermind will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.

9. Indemnification

You agree to indemnify and hold Hammermind harmless from claims, damages, and expenses arising out of your Inputs, your Outputs, or your use of the Service in violation of these Terms or law.

10. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms or to protect the Service. On termination, any remaining credit balance is non-refundable (see Section 3); provisions that by their nature should survive (ownership, disclaimers, liability, indemnity) will survive.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, and the courts located there will have exclusive jurisdiction, unless a different mandatory law applies to you as a consumer.

12. Changes

We may update these Terms; material changes take effect when we post them (see the "Last updated" date) and your continued use constitutes acceptance.
